Terms and Conditions for Cheshire Slate Reclamation

Please read these Terms and Conditions ("Terms") carefully before using the Cheshire Slate Reclamation website or purchasing any materials from us. By accessing our website, making an enquiry, placing an order, or purchasing materials, you agree to be bound by these Terms.
1. Introduction
Cheshire Slate Reclamation ("we", "us", "our") specialises in the sourcing, stripping, and sale of high-quality reclaimed roofing materials, including slates and tiles. These Terms govern the sale and supply of all materials by us to you.
2. Nature of Reclaimed Materials
2.1. All materials sold by Cheshire Slate Reclamation are reclaimed and salvaged. This means they are pre-used and have been removed from existing structures.
2.2. Due to their reclaimed nature, these materials are inherently imperfect. They will display signs of age, weathering, wear, and variations in colour, size, thickness, and texture. Such characteristics are considered part of their unique appeal and do not constitute defects.
2.3. We strive to salvage and sell only high-quality materials, but minor chips, cracks, variations in cut, and other imperfections are to be expected and are not grounds for return or refund, unless they significantly impair the material's structural integrity or intended use, as determined by us.
3. Pricing and Payment
3.1. All prices for materials are as quoted by us and are subject to change without prior notice. 3.2. Payment terms will be agreed upon at the time of order confirmation. Full payment is typically required before collection or delivery of materials.
4. Inspection of Materials
4.1. On-Premises Inspection (for Collections): If you are collecting materials from our premises, it is your responsibility to thoroughly inspect all slates and other materials before they leave our yard. Once materials have been loaded and have departed our premises, we cannot accept responsibility for any damage, discrepancies, or dissatisfaction with their condition.
4.2. Delivery Inspection (for Deliveries): If materials are delivered to your site, it is your responsibility to thoroughly inspect all materials before the delivery driver leaves. Any visible damage, discrepancies in quantity, or issues with the order must be noted on the delivery note and brought to the driver's attention immediately. Claims for damage or missing items will not be accepted once the driver has departed your site, unless otherwise agreed in writing.
5. Delivery
5.1. Delivery Location: All deliveries are made to the kerbside (footpath) or to the nearest accessible point where our delivery vehicle (including a HIAB crane, if applicable) can safely reach and offload the materials. This is at the sole discretion of the driver, taking into account safety and accessibility.
5.2. Access: It is your responsibility to ensure that the delivery location has suitable access for our delivery vehicles. Any additional costs incurred due to inadequate access (e.g., re-delivery charges) will be your responsibility.
5.3. Offloading: While our drivers will assist with offloading to the agreed point, it is your responsibility to arrange for the safe and timely movement of materials beyond the initial drop-off point.
6. Refunds and Returns
6.1. General Policy: We want you to be satisfied with your purchase. However, due to the nature of our reclaimed materials and the manual handling involved, our refund policy is as follows:
6.2. Restocking Charge: Refunds for returned materials will incur a 20% restocking charge. This charge is applied to cover the significant time, labour, and operational costs associated with processing returns of our heavy, reclaimed roofing materials. This includes, but is not limited to, the manual unloading and re-loading of materials, careful inspection to ensure they meet our high-quality standards for resale, and their re-stocking within our yard. This policy helps us to minimise over-ordering, maintain efficient operations, and ensure our materials remain available for all customers.
6.3. Condition of Returned Materials: Returned materials must be in the same condition as when they were supplied, suitable for immediate resale. Materials that have been cut, altered, damaged after delivery, or are otherwise not in a resalable condition will not be eligible for a refund.
6.4. Notification of Returns: You must notify us within [e.g., 7 days] of delivery if you wish to return materials. Returns must be arranged and paid for by you, unless the return is due to an error on our part or a significant defect not covered by Section 2.
7. Limitation of Liability
7.1. Cheshire Slate Reclamation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the materials; (b) any conduct or content of any third party on the materials; or (c) unauthorised access, use or alteration of your transmissions or content.
7.2. Our total liability to you for any breach of these Terms or otherwise arising in connection with the sale of materials shall be limited to the total price paid by you for the materials in question.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
